Consequences of Lying to Banks When Filing For Mortgages

  Having a big, decent, comfortable home is everyone's dream. Although indeed each person's dream home can be different, but in reality every Indonesian has the right to have a decent, comfortable, and safe residence.


However, when viewed from the number of Indonesian citizens it is not possible if everyone has one house. For that, the apartment is the answer to the problem of increasingly swelling the number.

It is still possible in the present to have a residence because of the convenience provided by the bank to help you buy a house. The assistance is in the form of a program called MORTGAGE or Home Ownership Credit.

Case Example

 Let's make an illustration of the case, with the main character we call a mother named Anna. Anna's mother had a desire to have a house to live in with her husband who had just married. The husband's profession of Anna's mother was a ship captain who in fact required her husband to move around.

Once, Anna's mother applied for a mortgage at one of the banks such as Danamon mortgage. Then the bank refused to process Anna's mother's application due to her husband's profession that required her to move around very often.

Therefore, Anna's mother has the sense to use her ID card that is still single (because it has not been replaced after marriage).

Then the process runs smoothly until the repayment process has been going on for five years. At one time, the husband of Anna's mother did not accept because the deed of heavy land was not the husband but Anna's own mother.

Anna's mother then intends to replace it by going to the bank and claiming to have only married 5 months ago. Anna's mother was then asked by the bank to hand over a copy of the marriage license.

The Emergence of Problems

Problems are starting to arise here. To change the name on the land deed previously in the name of Anna's mother to the name of the husband, Anna's mother admitted to the bank that she had only been married five months ago, in fact they had been married for five years.

This led the bank to claim that there was information that was not fully provided by Anna's mother, or that Anna's mother had lied to the bank. The most likely bird that could happen is a recall of a house that has been in installments for five years by the bank because the bank feels it has been deceived.

Next Possibility

From the example of the case, the bank has a strong enough basis to be able to sue for the cancellation of credit agreements, and also Anna's mother could be reported for fraud. Because at the time of applying for credit, Anna's mother did not give the actual data to the bank.

Then, in accordance with article 36 Paragraph (1) of Law No. 1 of 1974 on Marriage (UUP), "regarding the joint property of the husband or wife can act on the agreement of both parties". In other words, joint property must be done with the consent of the married couple.

So, when Anna's mother claimed to be single at the time of applying for credit, but in reality she was married. This can be a problem when there is bad credit. Especially when the husband of Anna's mother denied having agreed to the transaction. The bank can sue Anna's mother for violating Article 378 of the Criminal Code (Criminal Code) regarding fraud.

If in the judicial process Anna's mother loses and is proven to have committed fraud, the bank can make the court's decision on the basis of fraud as a basis for filing a lawsuit to cancel the home loan agreement. 

Risk of Losing a Home


The worst part of all the illustrations above is that Anna's mother lost the house that had been in installments for five years along with the money that had been deposited, as all previous transactions were deemed never to have happened. Not to mention, there is a possibility that Anna's mother could have been thrown into prison for her actions.

So, the consequences of lying to the bank can end very badly, right? Therefore, avoid any form of falsification of information and provide real data to the bank if you want to do credit.
